David
J. Gruber is a partner of Gruber, Schwartz & Posnock,
LLP. Mr. Gruber has been an attorney in New Jersey since
1983. Since that time he has been a licensed and practicing
member of the New Jersey State Bar as well as the District
Courts of New Jersey and the Third Circuit Court of
Appeals. Mr. Gruber has been licensed and practicing
in New York since 1986 and is a member of the New York
State Bar as well as the Southern and Eastern Federal
District Courts of New York and the Second Circuit Court
of Appeals. Mr. Gruber is also licensed to appear before
the United States Supreme Court. From 1992-2004 Mr.
Gruber was a partner of Lehman, Lehman & Gruber
and “of counsel” to the firm of Schwartz
& Posnock. Prior to that he had his own firm in
Livingston, New Jersey for a number of years after he
was an Associate at Stern, Dubrow & Marcus in Maplewood,
New Jersey.
Mr. Gruber is a graduate of Franklin & Marshall
College and Case Western Reserve University School
of Law. He is a member of the Association of Trial
Lawyers of New Jersey (ATLA-NJ) as well as the Essex
County Bar Association and the Union County Bar Association.
Mr. Gruber has litigated, tried and/or handled numerous
cases in the following areas: Personal Injury; Medical
Malpractice, Wrongful Death; Commercial/Business Litigation,
Various types of Civil Litigation, Matrimonial/Family/Custody/DYFS
Litigation; Real Estate Litigation, Employment/Civil
Rights and Wrongful Termination Litigation; ERISA
Disability Litigation; and Appellate Practice in both
State and Federal Courts.
Throughout
the years Mr. Gruber has handled a wide variety of
personal injury litigation from routine rear-end cases
to complex cases involving multiple parties, avenues
of recovery and insurance policies including Underinsured
and Uninsured Motorist claims. Other kinds of personal
injury cases he has handled include recreational/sports
injuries; slip and falls on ice, in the supermarket
or because of defective walking or other surfaces.
Mr. Gruber has litigated medical malpractice cases
involving, among others, negligent laparoscopy, sterilization
and other OB-GYN procedures; wrongful death; fetal
death; failure to monitor and cases involving negligent
infusion therapy and IV-line administration. He has
also handled complex ERISA/disability litigation (See
Lasser v. Reliance Std. Life Ins. Co., 130 F.
Supp. 2d 616 (D.N.J. 2001); 146 F. Supp. 2d 619 (D.N.J.
2001)) as well as various kinds of wrongful termination,
discrimination and Civil Rights claims (See Holmin
v. TRW, Inc., 330 N.J. Super. 30 (App. Div. 2000)
and Holmin v. TRW, Inc., 167 N.J. 205 (2001).
Holmin involved the Court’s construction of
the date on which the statute of limitation begins
to run for a discharged employee. There, both the
Appellate Division and the Supreme Court agreed with
Mr. Gruber’s arguments that a plaintiff's cause
of action (for fraud) accrues on the effective date
of his or her discharge rather than the date the employee
receives notice of termination from the employer.
Mr. Gruber was trial counsel in State v. Smith,
295 N.J. Super. 399 (Law Div. 1996) which involved
issues of first impression under the Vicious and Potentially
Dangerous Dog Act , N.J.S.A. 4:19-22 and its
construction. A portion of that trial appeared on
a major television News channel. Mr. Gruber was also
trial counsel for a group of neighbors in the matter
of Davis v. Morristown Congregation of Jehovah’s
Witnesses which resulted in the Court’s
enforcement of a restrictive covenant that prohibited
the building of anything other than a residence on
lands purchased by the defendant. Together with David
A. Schwartz, Mr. Gruber has handled litigation of
oppressed minority shareholder claims and complex
claims of multi-national companies involving issues
of breach of contract, fraud and investment capital/financing.

David
A. Schwartz is a partner in the law firm of Gruber,
Schwartz & Posnock. Mr. Schwartz, an attorney since
1983, is licensed in the State and Federal Courts of
New Jersey, New York, Pennsylvania, and California,
as
well as before the United States Supreme Court. Member-
Executive Committee of the Criminal Law Section of the
State Bar of California.
From
2001 through 2003 Mr. Schwartz acted as Special Assistant
Corporation Counsel for the City of New York in the
Special Federal Litigation Division, where he received
the Division Chief's Award for Outstanding Legal Service
to The City. In this role he was responsible for handling
the case of Estate of Patrick Dorismond v. Rudolph
Guliani, et. al. and cases resulting from the Mollen
Commission Investigation of the Thirtieth Precinct
("The Dirty 30").

Leslie
B. Posnock is a partner in the law firm of Schwartz
& Posnock. Ms. Posnock, an attorney since 1984,
is licensed in the State and Federal Courts of New Jersey,
Pennsylvania, and California. Ms. Posnock is a former
public defender in Philadelphia and New Jersey. Ms.
Posnock has handled or tried hundreds of cases, including
murder, drugs, sexual assault, mail fraud, wire fraud,
embezzlement, forgery, kidnapping, robbery, assault,
burglary, Municipal Court matters, and driving under
the influence cases.
She has also represented witnesses before Federal and
State Grand Juries, and has obtained expungements for
her clients. Ms. Posnock has lectured on criminal law
topics to the Bar Association of San Francisco young
lawyers division, and has written articles on criminal
law topics, including "A Model Code of Conduct,"
Business Crimes Bulletin, Compliance and Litigation,
Vol. 1, No. 3, April 1994. While a student at the University
of Pennsylvania, Ms. Posnock worked for the Hon. A.
Leon Higginbotham, Judge of the United States Court
of Appeals for the Third Circuit.
